1. Purpose and scope
These general terms and conditions of sale (the "Terms") govern all relationships between GLOBALCLOUDHOSTING SAS, a simplified joint-stock company with share capital of €250,000, registered with the Paris Trade and Companies Register under number 884 215 903, with registered office at 14 rue de la Verrerie, 75004 Paris, France (the "Provider"), and any natural or legal person subscribing to a virtual private server plan (the "Customer").
Placing an order implies full acceptance of these Terms, which prevail over any other document. The applicable Terms are those in force on the order date.
2. Description of services
The Provider offers virtual private server (VPS) rentals with administrator (root) access, including the compute, memory, NVMe storage and bandwidth resources described on the Pricing page. Each plan includes a dedicated IPv4 address, Anti-DDoS protection and rescue console access.
The Provider reserves the right to evolve plan specifications; any resource upgrade is applied at no extra cost to existing customers upon the following renewal.
3. Ordering and activation
Orders are placed online. The Customer selects a plan, a datacenter location and an operating system, then pays in cryptocurrency through the Oxapay payment provider.
The service is provisioned automatically after payment confirmation on the relevant blockchain, within an average of 55 seconds. Initial access credentials are displayed on the order confirmation page and remain available from the customer dashboard.
4. Pricing and payment
Prices are quoted in US dollars (USD) excluding taxes. Applicable VAT is computed according to the Customer's country of residence. Payment is made exclusively in cryptocurrencies (BTC, ETH, USDT and other networks supported by Oxapay).
Any payment is firm and final once confirmed on the blockchain. In case of partial underpayment, the order remains pending until settled or until the 30-minute window expires.
5. Term and renewal
Plans are subscribed for one month, renewable. Renewal is not automatic: the Customer receives a reminder 7 days then 24 hours before expiry. Failing renewal, the VPS is suspended at expiry then deleted after 7 days, with permanent data loss.
6. Right of withdrawal
Pursuant to Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period with the Customer's express consent. Immediate delivery of the VPS after payment constitutes full performance. The Customer nevertheless benefits from the guarantees of our Refund Policy.
7. Liability
The Provider is bound by an obligation of means regarding infrastructure availability and security, in accordance with the SLA published on the site. The Provider shall not be liable for content hosted by the Customer, nor for indirect damages (loss of revenue, data loss attributable to the Customer, reputational harm).
In any event, the Provider's liability is capped at the amounts paid by the Customer over the last three months.
8. Governing law and disputes
These Terms are governed by French law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the competent courts of Paris, unless mandatory provisions provide otherwise. Consumer Customers may freely refer to the competent consumer mediator.
